Your Rights as a Tenant in Ghana

Understanding your rights is the first step toward protecting yourself in Ghana's rental market. NATUG has compiled comprehensive information about tenant rights under Ghanaian law to ensure you're equipped with the knowledge you need to demand fair treatment and hold landlords accountable.

Right to a Written Tenancy Agreement

Every tenant in Ghana is entitled to a clear, written tenancy agreement that specifies the rent amount, payment schedule, duration of tenancy, responsibilities of both parties, and conditions for termination. Verbal agreements, while common, leave tenants vulnerable to disputes and misunderstandings. NATUG provides free tenancy agreement review services to ensure your contract is fair and legally sound.

Right to a Safe and Habitable Dwelling

Ghanaian law requires landlords to maintain rental properties in safe, sanitary, and habitable condition. This includes functional plumbing, electrical systems, structural integrity, adequate ventilation, and freedom from pest infestations. If your landlord fails to address serious maintenance issues that affect your health or safety, you have the right to demand repairs or seek legal recourse through NATUG's dispute resolution services.

Right to Fair Rent and Transparent Charges

While Ghana does not currently have universal rent control laws, tenants have the right to understand all charges before signing a lease. Landlords must clearly explain rent amounts, utility charges, service fees, and any additional costs. Sudden, unexplained rent increases during the lease period are generally prohibited without mutual agreement and proper notice.

Right to Non-Discrimination

No landlord may refuse to rent to you based on your ethnicity, religion, gender, marital status, disability, or other protected characteristics. Discriminatory practices violate Ghana's constitutional guarantees of equality and dignity. NATUG actively fights housing discrimination through legal advocacy and public awareness campaigns.

Right to Due Process in Eviction

Landlords cannot forcibly evict you without following proper legal procedures. You are entitled to adequate written notice (typically 3-6 months depending on your lease terms), and landlords must obtain a court order before removing you from the property. Self-help evictions4including changing locks, removing belongings, or shutting off utilities4are illegal and punishable under Ghanaian law.

Our Mandate & Legal Foundation

NATUG operates under the authority of Act XX and Ghana’s comprehensive Housing Regulations, establishing our legal right and responsibility to represent tenants nationwide. Our mandate is both clear and comprehensive, encompassing five critical areas of tenant protection and housing sector reform.

First and foremost, we exist to protect the legal rights and interests of tenants across every region of Ghana. This means ensuring that tenancy agreements are fair, transparent, and legally sound; that rental charges are reasonable and clearly explained; and that tenants have recourse when their rights are violated.

Second, we actively advocate for transparent and fair rental practices throughout the housing market. We work with landlords, property managers, and housing associations to promote ethical standards and accountability in the rental sector.

Third, we provide direct support to members in resolving disputes and accessing justice. Whether through mediation, legal guidance, or representation, we stand beside our members when conflicts arise.

Fourth, we drive public policy and rental sector reform by engaging with government ministries, parliamentary committees, and regulatory bodies to shape laws and policies that protect tenants and promote affordable housing.

Finally, we work to educate and empower tenants with knowledge about their rights, responsibilities, and options, ensuring every Ghanaian can navigate the rental market with confidence.
